Before you take possession of your new home, the “état des lieux d'entrée” is a key step. This document draws up a precise inventory of the property's condition, and is binding on both tenant and owner. A well-executed inventory of fixtures is your best protection against future disputes. Here's everything you need to know about how to do it properly.


What is the “état des lieux d'entrée”?

It's a document drawn up when the keys are handed over, and signed by both parties. It describes the condition of the property, room by room, as well as its fixtures and fittings. It is often accompanied by photos and sometimes meter readings. Although not legally required in all cantons, it is highly recommended, as it helps to avoid disputes during the move.


Why is it so important?

An accurate inventory of fixtures and fittings enables us to determine who is responsible for any damage when you move out. In the absence of an inventory of fixtures, the tenant's word is against the landlord's, and the risk of losses on the rent guarantee increases.


Our tips for a successful inventory of fixtures

1. Choose the right time

Preferably during the day, to take advantage of natural light. The apartment should be empty so that all details are visible.

2. Go through everything

Test all installations: hot water, hotplates, sockets, switches, toilet flushes, heating, household appliances... Don't hesitate to point out the slightest anomaly.

3. Every scratch, stain or crack must be mentioned

Specify the location and nature of the defect.

4. Take dated photos of all parts and defects

These images can be used as a reference in the event of a dispute.

5. Keep a copy of the signed document

The report must be drawn up in duplicate and signed by both parties. Never sign it if you don't agree.

6. Report undetected defects promptly

You have 10 to 30 days (depending on your contract/agreement) to notify us in writing of any defects identified after moving in.


In the event of a dispute

If a disagreement arises at the time of the inventory of fixtures, e.g. over the attribution of damage or the amount claimed, it's important not to sign under pressure. To protect your rights, you can write on the minutes “does not constitute an acknowledgement of debt”. If you discover a problem after the fact, or feel you have been misled, you can contest the agreement on the grounds of “essential error” by registered letter within one year. In case of doubt or conflict, don't hesitate to contact ASLOCA (Swiss Tenants' Association), who can inform you of your rights and help you with the necessary steps. As a last resort, you can also contact the cantonal conciliation office free of charge to try and resolve the dispute amicably.
